A home purchase in Taipei often runs to tens of millions of NT dollars. What keeps people up at night is rarely the price; it is the problem discovered after signing: a restriction on the land registry transcript nobody understood, a co-owner who never agreed, a leak that appears after handover, or a tax miscalculation that costs hundreds of thousands.
Jerry Chen graduated from the National Taiwan University College of Law and practices as an attorney focused on real estate, inheritance and family matters. He is also registered as a licensed real estate sales agent with HB Housing. At every stage of the deal, the legal risks are checked and put in writing first.
Beyond showings and price negotiation, the four stages where deals most often go wrong are reviewed item by item.
Land registry transcripts, title certificates, encumbrances, registered restrictions, co-ownership and zoning are confirmed before listing and viewing, and any concerns are explained up front.
Loan shortfalls, leaks and defects, stigmatized property, handover deadlines and unpermitted additions: what both sides agreed is written into the special terms.
Unregistered inheritances, joint ownership, co-owners who refuse to sell: most agents avoid these properties, but a lawyer knows the procedure.
Consolidated House and Land Income Tax, owner-occupier relief, replacement-purchase refunds, and whose name to buy in: run the numbers and plan before you buy.
The process of buying or selling a home is not complicated; the difficulty is in the details hidden at each stage. Here is what gets extra attention at every step.
Pull the land registry transcripts and confirm the owner, encumbrances, registered restrictions and zoning.
Explain the difference between an earnest-money offer and a written offer, withdrawal conditions and when each takes effect.
Verify the seller's identity, that all co-owners are present and that any power of attorney is valid, and draft the special terms.
Confirm the escrow account, seal certificates and the agreed split of taxes and fees item by item.
Estimate Land Value Increment Tax and Deed Tax, and flag the income tax filing deadline and owner-occupier relief conditions.
File with the land administration agent and watch for new seizures, provisional attachments or other registrations.
Inventory checklist, final payment, mortgage release, and photos recording the property's condition.
Land Value Increment Tax, Deed Tax, Stamp Tax and registration fees, plus the Consolidated House and Land Income Tax holding period and owner-occupier relief.

Behind every transaction is an important decision for a family.
My father left an old walk-up, and one of the five siblings kept refusing to sell. Attorney Chen used the majority-rule procedure under Land Act Art. 34-1, handling the notices and the court deposit step by step. The home sold, and the family did not fall out over it.
I live overseas and our home in Taiwan had sat empty for years. From the overseas authorization documents and the tax estimate to the sale and transfer, most of it was handled remotely, so I did not have to fly back again and again.
After my husband passed away, I learned we had to register the inheritance and file the estate tax, and I also wanted to move somewhere smaller. Everything from the inheritance procedure to the sale was handled end to end.
Before signing, Attorney Chen pulled the transcript and found a provisional attachment had just been registered on the seller's home, and advised us to hold off on paying. We bought a home with a clean title instead.
There had been a leak that was repaired years ago, and I was not sure whether to mention it. Attorney Chen suggested putting the repair records into the disclosure statement and contract. There was no dispute after handover.
Before buying, we compared putting the home in my name, 50/50 with my wife, or our children's names, including gift tax and the future income tax on sale. Seeing the numbers side by side made the choice easy.
My ex-husband and I co-owned a home and could not agree on anything. Attorney Chen set out the sale process and how the proceeds would be split. Once both of us agreed, it sold smoothly.
Selling the old home and buying the new one was a tight schedule. Attorney Chen flagged the deadline and conditions for the replacement-purchase tax refund and listed every document, and we got part of the Land Value Increment Tax back.
